These Terms of Service (“Terms”) govern your use of posoulo.com and purchases made through the Posoulo online store. The store is operated by Posoulo Inc. (“Posoulo”, “we”, “us” or “our”) and is hosted on Shopify.
By accessing the Site or placing an order, you agree to these Terms and to the policies incorporated by reference below. If you do not agree with these Terms, please do not use the Site.
1. Online store eligibility and lawful use
You may use the Site only for lawful purposes.
By placing an order, you represent that you have the legal capacity to enter into the transaction in your jurisdiction.
You must not misuse the Site, interfere with its security or operation, transmit malicious code, access or scrape the Site unlawfully, or infringe the rights of Posoulo or others.
2. Products and presentation
We make reasonable efforts to describe and display our products accurately.
Because Posoulo gift experiences include natural materials, gemstones, botanicals and handmade elements, individual variations may occur. Colours may also appear differently depending on your device or display.
Product descriptions, availability, specifications and pricing may be corrected or updated where reasonably necessary, subject to applicable law.
Products may be available in limited quantities. We may limit or discontinue products or quantities where permitted by law.
3. Orders, pricing and payment
You agree to provide accurate billing, shipping and contact information when placing an order.
Submitting an order constitutes an offer to purchase. We may accept, decline or cancel an order where reasonably necessary, including in cases involving:
- inventory errors
- payment problems
- suspected fraud
- obvious pricing or listing errors
- shipping restrictions
- legal or regulatory requirements
If we cancel an order after payment has been captured, we will provide the appropriate refund.
Prices, taxes, shipping charges and other amounts payable are displayed during the purchase process where applicable.
Prices may change before an order is placed.

Delivery estimates are estimates rather than guarantees unless expressly stated otherwise or required by applicable law.

Nothing in these Terms limits mandatory consumer rights that cannot legally be excluded or restricted.
6. Customer accounts
Customer accounts are optional unless a particular transaction or feature expressly requires one.
Posoulo currently uses Shopify’s customer-account system.
You are responsible for maintaining control of the email account and authentication methods you use to access customer-account features and for notifying us if you believe your account has been accessed without authorization.
7. Intellectual property
The Site and its content, including Posoulo names, logos, trademarks, product presentation, text, graphics, photographs, videos, designs and other original material, are owned by or licensed to Posoulo and are protected by applicable intellectual-property laws.
Except as permitted by law, you may not reproduce, distribute, modify, publish, commercially exploit or create derivative works from Site content without prior written permission from Posoulo.
8. Third-party services and links
The Site may use or link to services provided by third parties, including Shopify, payment providers, carriers and other service providers.
Third-party services may be governed by their own terms and policies.
Posoulo is not responsible for third-party websites or services that it does not control, except to the extent responsibility cannot legally be excluded.
9. Reviews, feedback and submissions
If you voluntarily submit feedback, suggestions, reviews or other content to Posoulo, you represent that you have the right to provide it and that it does not violate applicable law or third-party rights.
You grant Posoulo a non-exclusive, worldwide, royalty-free licence to use, reproduce and display content you voluntarily submit for purposes connected with operating, improving and promoting Posoulo, subject to applicable privacy law and any separate terms presented when the content is submitted.

11. Errors and corrections
We may correct typographical errors, inaccurate information or omissions relating to product descriptions, availability, pricing, promotions, shipping or other Site content.
If a correction materially affects an order you have already placed, we will handle the matter fairly and in accordance with applicable law.
12. Site availability and limitation of liability
To the maximum extent permitted by law, the Site is provided on an “as available” basis and we do not guarantee that access will always be uninterrupted or error-free.
To the maximum extent permitted by law, Posoulo is not liable for indirect, incidental, special or consequential loss arising solely from use of the Site.
Nothing in these Terms excludes or limits liability, warranties, conditions, remedies or consumer rights that cannot legally be excluded or limited.
13. Indemnity
To the extent permitted by law, you agree to indemnify Posoulo against third-party claims arising from your unlawful misuse of the Site or your material violation of these Terms.
14. Severability and waiver
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in effect to the extent permitted by law.
A failure by Posoulo to enforce a provision does not constitute a waiver of that provision.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without limiting any mandatory consumer rights you may have under the laws of your place of residence.
16. Changes to these Terms
We may update these Terms to reflect changes to the Site, our practices or legal requirements.
The current version will be posted on this page with an updated “Last updated” date.
Changes apply prospectively except where applicable law permits otherwise.
